What changes in version 1.2. Usage statistics, which you switch on yourself, now go to Amplitude — a product-analytics tool in the EU region — in addition to our database in Ireland. See § 5 item 6 and, in detail, the Privacy policy. Published 14 days in advance (§ 13 item 2); version 1.1 applies until 4 October 2026.
This is a courtesy translation. In case of any discrepancy, the Polish version prevails.
In short
This summary is not part of the Terms and has no binding force. It's only meant to save you time.
- Tup Quest is a game about the city. You walk, streets get marked, you find cultural places.
- It's free. No ads, no in-app purchases, no subscription.
- You don't create an account. You give no e-mail or password.
- Your progress is saved on your phone and stays there.
- The app uses the network for maps and updates, the optional leaderboard and groups, and statistics and error reports that require consent. With your consent, statistics go to our database and to Amplitude. GPS tracks go neither to the leaderboard, nor to statistics, nor to Amplitude.
- Don't cheat: no location spoofing, no gaming the scores.
- Most important: watch the road, not the phone. No place in the game is worth an accident or trespassing.

§ 1. Who is who and what these words mean
- Provider (also "we", "us") — Cybird Consulting Dariusz Ptaszek, a sole proprietorship registered in the Polish CEIDG register, contact address: ul. Chmielna 2/31, 00-020 Warsaw, Poland, NIP (tax ID) 7343126589, REGON 387337946. Contact e-mail: d.ptaszek@gmail.com. Website: https://tup.quest.
- App — the Tup Quest mobile application for iOS and Android, in its Polish and English language versions, with all its screens, data and content.
- User (also "you") — a person who has downloaded and launched the App on their Device.
- Consumer — a User who is a natural person using the App for purposes not directly related to their business or professional activity. Provisions of the Terms more favourable to the Consumer also apply to a sole trader with consumer rights within the meaning of Article 7aa of the Polish Consumer Rights Act.
- Device — a phone or tablet running iOS or Android on which the App is installed.
- Store — the App Store run by Apple or Google Play run by Google, from which you download the App and its updates.
- Terms — this document. It constitutes terms of providing services by electronic means within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
- Privacy policy — the document describing what data the App processes and what happens to them, available at https://tup.quest/en/privacy (Polish: https://tup.quest/prywatnosc) and in the App under Settings → Documents.
- Walk — a route-recording session you start with the "Start a walk" button and end with the "Finish" button.
- Walked street — a street segment the App has deemed walked on the basis of GPS readings during a Walk.
- Place — a point on the map you find by getting close enough to it. Places come from OpenStreetMap data or from Collections.
- Collection — an editorial set of Places from one cultural field: music, film, literature, pop culture, history, art.
- Game elements — experience points (XP), 10 levels, 66 badges, the daily challenge and the weekly league (5 leagues). These are numbers in a game. They have no monetary value and cannot be bought, sold, exchanged or transferred to another Device.
- Online leaderboard — an optional function comparing league scores between Users within one city and one week. You join it by entering a Nickname; until you do, you don't take part.
- Group — a private leaderboard for people who know its invite code. A User starts a Group by naming it; the App draws an eight-character code with which you invite others.
- Player identifier — a random string assigned at first connection to the server, for the purposes of the Online leaderboard, Groups and usage statistics. It is not the IDFA, a hardware identifier or any advertising identifier. It is accompanied by neither an e-mail address nor a password — the App runs no User accounts.
- Nickname — a name you enter yourself if you want to appear on the Online leaderboard and in Groups.
- OSM data — map data from the OpenStreetMap project: street geometry, district boundaries and some Places.
- Editorial content — Collection descriptions, notes on Places, badge texts, level names, graphics and everything else written and designed by the Tup Quest editors.
§ 2. What the service is and how it works
- The App is a game about the city. The map marks the streets you have actually walked and the cultural Places you find by approaching them.
- The App covers all 18 regional capitals of Poland: Warszawa, Kraków, Łódź, Wrocław, Poznań, Gdańsk, Szczecin, Bydgoszcz, Toruń, Lublin, Białystok, Katowice, Rzeszów, Kielce, Olsztyn, Opole, Zielona Góra and Gorzów Wielkopolski. As of the effective date of these Terms, Collections exist in 11 of them — in the rest they are in preparation, and the App says so plainly on the Discover screen. The list of cities may change — cities may be added.
- The App is not a fitness or health app. It shows no pace or heart rate. There is no step goal. The step count appears in one place, as a curiosity read live from the system pedometer, and does not affect points. The App stores it nowhere.
- The calorie figure in the Walk summary is a joke, not a measurement. We compute it on the Device as a fixed factor of the distance covered, assuming a weight of 75 kg. The App doesn't ask for weight, height, age or sex and doesn't know them, so the figure does not refer to you and is unfit for any health or dietary purpose. It is stored and sent nowhere, and does not change Game elements in any way.
- The App is not a medical device. It does not diagnose, treat, monitor health or assess whether exertion is safe for you.
- Guides provide orientation. The app suggests an order of places and a direction to the next stop. It does not account for every access restriction, traffic condition or change on the ground; follow local signs and entry rules.
- The contract for use of the App is concluded at the moment the App is first launched on the Device. You conclude it with the Provider for an indefinite period.
- You may end it at any time and without giving a reason — by uninstalling the App. You don't need to tell us. It involves no costs or consequences.
§ 3. The App is free
- We charge no fees for downloading or using the App.
- The App has no ads, in-app purchases, subscription, premium version, paid content or any other form of monetisation.
- We don't collect data about you for advertising purposes, and we don't sell data or share it with data brokers. Usage statistics and error reports are optional, off by default and require separate consent. Details in the Privacy policy.
- You do bear your own costs, which we don't control: data transmission with your carrier and the Device's battery consumption.
§ 4. There is no account
- The App has no user accounts. You don't create an account, log in, or provide an e-mail address or password.
- All your progress — walked streets, found Places, Walks together with the route trace as a series of coordinates, points, badges — is saved solely locally, in a database on your Device.
- We have no copy of your progress. It cannot be recovered if you uninstall the App, reset the Device or lose it. We also have no way to move it to another Device. Optional leaderboard, group and analytics records may remain on the server; they cannot restore local GPS history.
- In Settings you can delete your data in the App yourself. All progress is deleted, as well as the Nickname and Player identifier. The operation is irreversible.
§ 5. What your phone needs
- The App requires: iOS 16.4 or later, or Android 7.0 or later; a GPS module; free storage on the Device; and an internet connection — for downloading map tiles and checking for updates (paragraphs 4 and 5).
- To record Walks, the App needs permission to access location. The default "Only during a walk" mode works from pressing "Start a walk" until "Finish". The "Automatically in the background" mode requires the "Always" permission and you turn it on yourself in Settings.
- You can revoke location and pedometer permissions at any time in the Device's system settings. Without location permission the App will not credit streets or Places — other functions will work.
- Map. The map uses vector tiles downloaded from the OpenFreeMap service (tiles.openfreemap.org). As with any online map, the tile provider sees your Device's IP address and which map fragments were requested. This connection cannot be avoided while using the map. The tile service is provided by a third party on its own terms.
- Updates. At launch the App asks the update server (u.expo.dev) whether a newer version of its software layer exists; if so, it downloads it and runs it at the next start. The request sends: the App installation identifier (a random, persistent string created at installation — not an advertising or hardware identifier), the runtime version, platform and update channel. Neither your coordinates nor routes nor game progress go there. The service is provided by Expo Project Services, based in the USA, which means a transfer of data outside the European Economic Area — described in the Privacy policy.
- Leaderboard, Groups and usage statistics. If you join the Online leaderboard or a Group (§ 1 items 14–15), the App connects to our server and sends: the Player identifier, Nickname, city name, week key, and the number of streets, Places and points. With separate consent, the App sends usage statistics linked to the Player identifier and error reports to Sentry. You can withdraw consent in Settings. We never send coordinates, track traces or the names of specific streets and Places. Leaderboard, group and usage-statistics data sit in our database on servers in Ireland. From there our server forwards a narrowed version of the statistics events onward to Amplitude — a product-analytics tool, with its project in the European Union region. Amplitude does not receive coordinates, track traces, street or Place names, your Nickname or Group names. Details are in the Privacy policy.
- These are all the App's network connections. Apart from map tiles, update checks, the Leaderboard with Groups, usage statistics and error reports to Sentry, the App connects to no server. To be clear: this is the list of connections leaving your phone, not the full list of recipients of your data. Forwarding statistics to Amplitude (item 6) is done by our server, on the database side — your phone does not connect to Amplitude. Section 7 of the Privacy policy lists every recipient.
- We recommend using the current version of the App and operating system. Older versions of the App may work worse or stop working.
§ 6. Rules of use
- Use the App in accordance with the law, these Terms and common sense.
- Don't cheat location. In particular, the following is prohibited: a) substituting, simulating or faking the GPS location (so-called spoofing), including by means of apps, developer modes and external devices; b) running the App on an emulator or in an environment simulating movement; c) using scripts, bots and automation that imitate walking; d) crediting streets in any way other than walking them under your own power.
- Don't game the scores. In particular, manipulating points, levels, badges and the league score is prohibited, as is sending false scores to the Online leaderboard, creating multiple entries for one person, and any interference with the data sent to the server.
- Don't tamper with the App. Modifying, decompiling and reverse-engineering the App's source code, circumventing its protections and creating modified versions based on it are prohibited — except where mandatory law allows it, including the provisions on permitted use and on the interoperability of computer programs.
- Don't overload us. Disrupting the App or its providers and copying Editorial content in breach of copyright are prohibited. This does not restrict rights granted by the ODbL or mandatory law.
- Nickname and Group name. If you enter a Nickname or start a Group, their names must be decent. Profanity, offensive, discriminatory or hateful content, advertising, and other people's personal data and trademarks are not allowed. Don't enter your own real name or other data by which you're easily recognised — other Users see the Nickname, and all members of a Group see its name.
- You start Groups at your own responsibility. You send the invite code to whomever you like, and anyone who learns it can join the Group and see its members' Nicknames and scores. We don't check who joins and don't moderate it on our own initiative.
- If you break these rules, we may — proportionately to the breach — remove your entry from the Online leaderboard, change or remove an inappropriate Nickname, and, in the case of persistent or serious breaches, block your Player identifier from the Online leaderboard. We have no technical means of blocking your access to the App itself or to your local progress, and we don't.
- We will inform you of the decision and its reason in the App, if technically possible. You may appeal any such decision by writing to d.ptaszek@gmail.com. We handle the appeal under the complaints procedure in § 10.
§ 7. Intellectual property
Three different things, three different regimes. Worth telling apart.
7.1. OpenStreetMap data
- Street geometry, district boundaries and some Places come from the OpenStreetMap project.
- These data are made available under the Open Database License (ODbL) 1.0, with attribution: © OpenStreetMap contributors. This notice is visible in the App.
- The ODbL has its own rules — including the attribution requirement and the share-alike rule for derivative databases. You may use OSM data under the ODbL. These Terms do not restrict rights granted by that licence, including extraction and reuse of data from the App. See https://www.openstreetmap.org/copyright.
- We claim no rights to OSM data and don't claim they are complete or current.
7.2. Editorial content and the App itself
- Cultural Collections are edited by the Tup Quest editors. Collection descriptions, notes on Places, badge texts, level names, the selection and arrangement of Places, graphics, icons, screen designs and the App's code are protected by copyright and belong to the Provider or its licensors.
- For the duration of your use of the App we grant you a non-exclusive, non-transferable licence, without the right to sublicense, limited to personal, non-commercial use of the App on your Devices, in accordance with its purpose.
- You may publish screenshots from the App — on social media, in texts, anywhere — provided you say it's Tup Quest. We're glad when you do.
- You may not copy, process or distribute Editorial content beyond what item 3 and the permitted-use provisions allow, or use it to build a competing database or service.
- The App uses open-source libraries. For those libraries their own licences take precedence over this section. We provide the list of libraries with their licence texts on request at d.ptaszek@gmail.com.
- Data that arise when you play — your routes, walked streets, found Places, points — are yours and stay on your Device. We claim no rights to them.
7.3. Trademark and name
- The name Tup Quest, the domain tup.quest, the wordmark, the logo (a grid of city blocks) and the App's visual identity are the Provider's designations.
- You may not use these designations in the name of your own app, service, domain, profile or product, or in a way suggesting you are affiliated with us or act with our consent.
- You may of course name us: in a review, article, post, guide, conversation. That's ordinary informational use and needs no consent.
§ 8. Safety — read this even if you read nothing else
- The App encourages you to walk around the city. You are responsible for your own safety. We don't see where you are and can't warn you.
- Don't look at the phone while crossing the road. Cross with the phone in your pocket. With background location permission, recording can continue while the screen is locked.
- Traffic rules matter more than the game. Always. No street, badge, league or daily challenge justifies running a red light, stepping into the road away from a crossing, or walking on tram or rail tracks.
- Don't go where you're not allowed. To find a Place you must not enter private, fenced or closed property, construction sites, railway, military or industrial premises, or closed buildings. Discover Places only from areas you may lawfully access. Map data and access conditions can change; if you cannot approach safely, skip the Place and report the issue. We cannot guarantee that every Place is accessible at all times.
- If a Place can't be found from the pavement — let it go and write to us at d.ptaszek@gmail.com. We'll fix the coordinates or remove the Place. That's an error on our side, not a task for you.
- Judge conditions yourself. Time of day, weather, lighting, traffic, the area, how you feel that day — that's your judgement and your decision. The App knows nothing about it.
- Children and teenagers. The App is not aimed at children under 13. If a minor uses the App, the parent or guardian is responsible for their safety during a walk.
- Health. If you're unsure whether a longer walk is safe for you, ask a doctor, not an app.
- In an emergency, call 112. The App doesn't call for help, doesn't detect falls and doesn't pass your location to anyone.
§ 9. Limitation of liability
- The Provider is liable for non-performance or improper performance of the contract under the rules of the Polish Civil Code and — to the extent they apply to a free service — the Consumer Rights Act.
- We are not liable for the consequences of your decisions during a walk — in particular for accidents, collisions, falls, injuries, losses and damage resulting from using the Device in traffic, entering property where entry is not allowed, or the choice of route, place and time. We don't control these situations and have no influence over them.
- We don't guarantee GPS accuracy. Location readings depend on hardware, operating system, buildings, weather and satellite availability. A street may not be credited although you walked it, or be credited by mistake. A Place may not be found although you're standing next to it. That's a normal property of GPS technology, not a defect of the App.
- We don't guarantee the correctness or completeness of map data. OSM data are created by volunteers; they can be outdated and incomplete. The map in the App is not a source of information on where you may enter, or on the condition of roads and pavements.
- We don't guarantee uninterrupted availability. The App may be unavailable or work worse due to failures, technical breaks, changes in operating systems, in the Stores or at the map tile provider. We try to keep it working, but it's a free service run by one person and we make no promises about response time to failures.
- We are not liable for loss of data stored locally on the Device — in particular after uninstalling the App, a reset, a failure or loss of the Device. By design we hold no copy of them (§ 4 item 3).
- We are not liable for the operation of third-party services the App uses or is delivered through: the map tile provider, the update service provider, the Stores, operating systems and your carrier.
- The above limitations don't apply where the law doesn't permit them. In particular, we don't exclude or limit liability: for damage caused intentionally, for personal injury (death, bodily injury, health disorder), or to the extent mandatory provisions don't allow limiting liability towards a Consumer. Nothing in these Terms limits a Consumer's statutory rights.
§ 10. Complaints
- If the App doesn't work as it should, or you have any objections — write to d.ptaszek@gmail.com. That's the only complaints channel and an ordinary e-mail is entirely enough. You may also write to the postal address in § 1 item 1.
- To make our life easier, describe: what the matter concerns, the Device model and system version, the App version (Settings → About), the city and — if possible — a screenshot. Missing this information is no reason to reject a complaint.
- We'll reply to a complaint within 14 days of receiving it, to the e-mail address you sent it from.
- Complaints concerning downloading the App, Store payments, updates and the Store account should be directed to the relevant Store — that's not an area we control.
- Apple Inc. and Google LLC are not parties to this contract and are not responsible for the App or for handling complaints about it.
§ 11. Out-of-court dispute resolution
- Using the methods below is voluntary and requires both parties' consent. You can always simply write to us first — most matters can be settled by e-mail.
- A Consumer may in particular use the help of: a) the district (municipal) consumer ombudsman — free of charge, in their own town or district; b) the permanent consumer arbitration courts at the voivodeship inspectorates of the Trade Inspection; c) mediation proceedings conducted by the voivodeship inspector of the Trade Inspection; d) consumer-protection organisations, e.g. the Federacja Konsumentów.
- Information on out-of-court resolution of consumer disputes is provided by the Polish Office of Competition and Consumer Protection (UOKiK): https://www.uokik.gov.pl and https://polubowne.uokik.gov.pl. Free consumer helpline: 801 440 220 and 22 290 89 16.
- ODR platform. The EU online dispute resolution (ODR) platform run by the European Commission ceased operation on 20 July 2025 and no longer accepts complaints. Use the methods listed in items 2 and 3 instead.
§ 12. Right of withdrawal
- The contract for use of the App is free of charge. We charge no price or any other form of payment, so there is nothing to refund. The App has no refund policy, because there are no payments.
- The App being free of charge does not exclude statutory consumer rights. Where withdrawal rules apply, including rules for digital services involving the provision of personal data, you may withdraw under the conditions and time limits set by consumer law. These Terms do not restrict those rights.
- Regardless of the above: you may stop using the App at any time, without giving a reason, without any deadline and at no cost. Just uninstall the App from the Device. Upon uninstallation the contract expires.
- If you wish to submit a formal statement of withdrawal or termination, send it to d.ptaszek@gmail.com. We'll accept and confirm it. No form is needed.
- Uninstalling the App permanently deletes all locally saved progress. It cannot be recovered afterwards.
§ 13. Changes to the Terms
- We may change the Terms for important reasons, in particular: changes in the law, changes to the App's functions, changes of service providers the App uses, security reasons, or correcting errors and ambiguities in the text.
- We'll announce a change with at least 14 days' notice, by publishing the new version with its effective date at https://tup.quest/regulamin (English: https://tup.quest/en/terms). A link to that address is in the App under Settings → Documents, so you can check the current version at any time. We have no technical means of notifying you individually: there are no accounts, we don't know your e-mail address, and the App sends no push notifications.
- If you don't agree to a change, you don't need to write anything or convince anyone — simply uninstall the App before the change takes effect. Using the App after that day means accepting the new version.
- A change to the Terms doesn't affect rights acquired before it took effect or complaints submitted earlier.
- Every version of the Terms has a number and an effective date. We provide previous versions on request at d.ptaszek@gmail.com.
- We may at any time stop developing the App or withdraw it from the Stores. We'll announce this with at least 30 days' notice, where possible, by publishing the information at https://tup.quest — the same channel as changes to the Terms (item 2). An App already installed on your Device will keep working as long as the operating system allows — but we can't guarantee that. Your local data stay with you.
§ 14. Governing law and courts
- Polish law applies to the contract and the Terms.
- The choice of Polish law doesn't deprive a Consumer of the protection afforded by mandatory provisions of the law of the country of their habitual residence (Article 6 of the Rome I Regulation).
- Disputes with a Consumer are heard by the court competent under the general provisions of the Polish Code of Civil Procedure. We impose no court on the Consumer.
- Disputes with a User who is neither a Consumer nor a sole trader with consumer rights are heard by the court competent for the Provider's seat.
- If any provision of the Terms proves invalid or ineffective, the remaining provisions stay in force. The invalid provision is replaced by the applicable provisions of law.
- In matters not covered by the Terms, Polish law applies, in particular the Civil Code, the Act on Providing Services by Electronic Means, the Consumer Rights Act and the Act on Copyright and Related Rights.
